hi to all

first, sorry for my bad english but it is very important to let you know, whats going on in germany

selling of selfmade levels at ebay.de

at the german ebay we found a game CD called Tomb Raider - Die Chronik (Part 2). There are 170 levels available on the CD.
nearly all (or all) levels are downloaded from the web and put on these CDs. the price is about $10

the license agreement says:

Well, is the guy making any money or does the $10 just cover costs of blank CD, CD case, postage and packing to anywhere in the world?

If he is just making a convenient option for people to get these levels without having to download 650 meg off the web but is making no money, I don't see the problem.

I am sure people will understand what you are saying Torry.

But does that $10 also include, for instance, the electricity bill, the time spent on downloading the levels, time spent on burning the level, time spent on conveying the goods to the nearest post office, cost towards the money spent on buying a computer, a CDR burner, and so on..........

The packaging is one thing. The equipment used as well as the labor and the time factor is another on top of that!

Wot do others got to say then?

I know of people who do get free stamps, free blank CDs, etc....

Just a thought ...

hi

a black CD does not cost more than $0,5. they just sell the CD by auction it.
the $10 are the minimum they want to have. the dispatch is extra.

so if you sell more than one CD you will earn money. but not only this fact i am angry, it the fact, that they take the level out of the web and do not ask anyone for doing that. secondly the license agreement says that no sell, rent, lease or commercially exploit these levels is allowed. so downloading or exchange levels between friends on CD is ok.

that what they do is not ok!

we will do something against that.

Well OK. It seems that the $10 is just for the levels as the postage and packing is extra.

Then I agree with you guyz. He is profiting om YOUR work and this should be challenged.

hallo, ich habe garnicht bemerkt, du bist moderator; wir sind die "stamm crew" aus dem deutschen forum. der link steht oben.
einige levelbauer wie webknight, ufo, helmut, volki sind dabei, die ich kenne. eventuell auch mein haus level. ich habe die CD nicht. deswegen kann ich das nicht sagen.
wir haben vor eidos und ebay zu mailen.
ich wollte nur auch hier bescheid geben, falls eine mailing aktion notwendig wird.
die größte sauerei ist, daß die lizenz das ausdrücklich untersagt! @GoranAgar if you can not read this i will translate it later.

Hallo Gerhard,

wenn Ihr selbst direkten Kontakt zu Eidos habt würde ich vorschlagen daß Ihr diese Kontakte nutzt und diese Info weitergebt. Ansonsten gebe ich das an RedLegg (Administrator hier) weiter. Es bringt nur nichts wenn 5 Leute bei Eidos die gleiche Info bekommen und anfangen Tätig zu werden. Was Ebay angeht würde ich das Eidos überlassen.

the german text says:
"Tomb Raider the Chronic (Part2)" are 2 CD´s with 170 level for "Tomb Raider the Chronic".
Most level including a story and partly with camera sqeuences so that more than 200 levels are available.
All levels are explaint in details and the levels be in a high quality. You thing that you are playing the 6th part of the tomb raider saga.

I, for one, am glad to see some feedback here.

If someone decided to supply people with copies of TR custom levels burnt onto CDs, then the customers wishing to receive such copies should provide with the blank CD and stamps!

The supplier should also make sure he/she gets the consent from the people who have put time into creating their levels.

Copier des jeux videos sur CD est une chose. Les vendre, s'appelle piraterie.

And by the way, to send a CD from UK to USA, costs me:


  • 91 pence in postage
  • 30 pence for an envelope
  • 40 pence per blank CD

TOTAL:£1.61 which roughly works out: $2.30 (£1=$0.70)

Its just making money out of core's work, can't they be taken to court for something like this, even though the cost may cover the cd cost etc, and my level's in there too,...sie sind schweinhunden

well, I'm from Holland, witch is next to Germany
however, it doesn't mean I can read it, let alone many other people that read this forum
and as far as that cd goes: that guy can't give us crap about posting costs and stuff, the fact is that he's making easy money on levels that he probebly downloaded in a day or two, witch were created for months by people like me
so, no, this is really, really wrong and I hope eidos will sew his *** !

They are the exact same levels in the exact same order from my site!
EIDOS AND CORE SHOULD SUE THEIR A$$E$!!!!!!!!
AND EBAY SHOULD KNOW BETTER NOT TO LET BURNT CD'S ON THEIR SITE!!!!!! THEY DON'T KNOW WHAT'S ON THEM!

I say: let's not wait for a possible answer from Eidos, let's all massivly bomb their e-mail with messages about that it's wrong and they should take actions to take this cd off e-bay

ok, i think, that´s enough at the moment. in germany we will have a look at ebay. if we recognize some problemes, i will start a new thread to inform you what´s going on.
i think we have to look at other electronic marked outside of germany. may be that somebody will offer an other CD ?!

well, I'd like to sell my own TR.... even if I am not doing it.... Eidos published only the editor, now we can: add ouwself composed music, owr own textures, owr own objects done with the CAD..... we can do things that eidos did not preview..... and then, we project our levels.... I spent so long and hard time to project my first level.... I don't want to be rich with it.... only paid for all those about 3 mounths... and I don't have finished yet.....

Yeah that would be fun, but...

- it seems for now that he will manage to sell 4 of these CDs on eBay for about US$10, which assuming we have about 80 Authors represented on the CD will earn you 50 cent if he does not keep anything for himself
- it would be illegal for us (as it is for him) to make any money out of it!!

I have sent the guy/company a personal eMail requesting that he withdraws his eBay offers as this is plainly illegal. If he does not do this I am considering legal action against him (after checking how much of a hassle this would be to carry through for me)

I checked out ebays piracy rules and he is breaking them . I tried to email evay but i can't find a support contact. So if any wants to inform ebay they will remove his items and slap him on the rist. Here is a small part of the contract:-

As a matter of eBay policy, software on CD-R (including CD-RW) may not be listed on eBay, unless the seller is the copyright owner and states this in the item description. This means that, among other things, compilations (e.g., multiple software programs on one disk), "freeware" and "shareware" on CD-R may not be listed on eBay. This policy also means that even lawful software on CD-R is not permitted on eBay. This following situation illustrates how this might arise.
Example: An individual or small software company decides to release its software on CD-R. The software company sells the software on CD-R on eBay to Jack. This is permissible because the software company is the copyright owner of the software. Jack now wants to resell the software on CD-R on eBay.
